Terms of Service

By accessing our website and utilizing our Services, you represent that you are at least 18 years of age and possess the legal capacity to enter into a binding contract. If you are using the Services on behalf of an organization or corporate entity, you represent and warrant that you have the authority to bind that organization to these Terms.

AGo Media, Inc. provides a suite of digital, media, and lifestyle services, including but not limited to:

• Digital & Corporate Branding: Domain management, digital marketing, and enterprise infrastructure scaling.
• Luxury Concierge & Hospitality (AGo Luxury): Facilitation of luxury short-term rental bookings, executive corporate retreats, private aviation, marine charters, and bespoke concierge itineraries.
• Media & Technology Platforms: Operation of digital media distribution, streaming services (such as BFree TV), and AI-integrated CRM workflows.

We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice.

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Services in any way that violates any applicable federal, state, local, or international law or regulation.
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which may harm AGo Media or users of the Services.
• Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Services, the servers on which the Services are stored, or any database connected to the Services.
• Use any robot, spider, scraper, or other automated means to access the Services for any purpose without our express written permission.

Certain aspects of the Services, specifically through AGo Luxury Concierge, involve the facilitation, brokering, or curation of third-party vendors (e.g., yacht charters, exotic car rentals, private chefs, and real estate management).

• Independent Contractors: These third-party vendors are independent contractors and not employees or agents of AGo Media, Inc.
• Liability Waiver: We are not liable for the acts, errors, omissions, representations, warranties, breaches, or negligence of any such third-party suppliers, nor for any personal injuries, death, property damage, or other damages or expenses resulting therefrom.
• Separate Agreements: Your utilization of third-party services may require you to sign separate liability waivers, charter agreements, or rental agreements directly with the fulfilling vendor.

The Services and their entire contents, features, and functionality (including but not limited to all information, software, AI models, text, displays, images, video, audio, and the design, selection, and arrangement thereof) are owned by AGo Media, Inc., its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

“AGo Media,” “AGo Luxury,” “AGo Luxury Concierge,” and all related names, logos, product and service names, designs, and slogans are trademarks of AGo Media, Inc. or its affiliates. You must not use such marks without our prior written permission.

Where applicable, AGo Media uses secure third-party payment processors (e.g., Stripe) to bill for services, digital products, and concierge reservations.

• Pricing & Arbitrage: Prices for concierge services and lifestyle access are subject to change. AGo Media, Inc. reserves the right to capture wholesale-to-retail margins on brokered experiences.
• Refund Policy: Unless explicitly stated otherwise in a specific service contract, booking agreement, or Master Lease Option (MLO) agreement, all consulting fees, planning retainers, and digital service charges are non-refundable.

YOUR USE OF THE SERVICES, THEIR CONTENT, AND ANY ITEMS OBTAINED THROUGH THE SERVICES IS AT YOUR OWN RISK. THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. AGO MEDIA, INC. DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL AGO MEDIA, INC., ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICES, ANY WEBSITES LINKED TO IT, OR ANY CONTENT ON THE SERVICES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, EVEN IF FORESEEABLE.

You agree to defend, indemnify, and hold harmless AGo Media, Inc., its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, and successors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

All matters relating to the Services and these Terms, and any dispute or claim arising therefrom or related thereto, shall be governed by and construed in accordance with the internal laws of the State of Florida, without giving effect to any choice or conflict of law provision or rule. Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Services shall be instituted exclusively in the federal or state courts located in the State of Florida.

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them. Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes.
